&&The good under review is the EcoWell Wireless Loadcell. It is a device that is suitable for Linear, Hydraulic and Beam pumping units and other applications requiring the measurement of load and/or positions. Load cells convert a force such as tension, compression, pressure, or torque into a signal that can be measured and standardized. The system primarily runs on EcoWell's solar rechargeable battery, with a lithium battery as a backup power source. The load cell has a superior wireless signal communication range. It provides various indicators to display important information about signal status and system conditions for easy on-site operation monitoring and it also has digital outputs for local backup battery warnings. The cell is also equipped with RS ports for remote Modbus communication.

&&Section 10 of the Customs Tariff directs that classification of imported goods shall be determined in accordance with the General Rules for the Interpretation of the Harmonized System and the Canadian Rules set out in the schedule. Section 11 of the Customs Tariff states that in interpreting the headings and subheadings, regard shall be had to the World Customs Organization's (WCO) Compendium of Classification Opinions and Explanatory Notes to the Harmonized Commodity Description and Coding System (HS).&&&&General Interpretative Rule 1 (GIR 1) directs that titles of Sections, Chapters and sub-Chapters are provided for ease of reference only. For legal purposes, classification shall be determined according to the terms of the headings and any relative Section or Chapter Notes. Similarly, General Interpretative Rule 6 (GIR 6) directs that classification shall be determined according to the terms of those subheadings and any related Subheading Notes.&&&&In your application for an advance ruling, you suggested tariff classification number 9026.90.00.90. This tariff classification number is incorrect.&&&&Consideration was given to Chapter 85, electrical machinery and equipment. Legal Note 1(m) for Section XVI states that the Section does not cover articles of Chapter 90, measuring instruments. Legal Note 3 to Section XVI states that composite machines consisting of two or more machines fitted together to form a whole and other machines designed for the purpose of performing two or more complementary or alternative functions are to be classified as if consisting only of that component or as being that machine which performs the principal function. The good under review performs two complementary functions, it measures a force and converts it into a signal that is transmitted to a terminal. The principal function of the good under review is the measurement of force by the load cell. Chapter 90 provides for measuring instruments therefore the good is not covered under Section XVI.&&&&Heading 90.31 more specifically provides for measuring or checking instruments. Explanatory Note 30 to the heading states the heading covers load cells which convert changes in applied force into proportional changes in voltage. The EcoWell Wireless Loadcell meets the requirements of Chapter 90 and heading 90.31, it is a device that measures force and converts it into a signal that can be measured and standardized. The good is correctly classified under 9031.80.00.90.
