&&This is a wireless battery-operated carbon monoxide detector that uses electrochemical sensing technology to detect the presence of carbon monoxide gas in the air. This detector has a 95 decibel alarm and three LED status indicator lights; it is used with the PowerMax+ or PowerMax Pro wireless security systems. When paired to the control panel of these systems, the model MCT-442 detector can wirelessly communicate an activated alarm to the control panel allowing it to transmit the alarm to the central station to alert the appropriate authorities.

&&Heading 85.31 of the Customs Tariff provides for electric sound or visual signaling apparatus other than those of headings 85.12 (Electrical signaling equipment (excluding articles of heading 85.39 of a kind used for cycles or motor vehicles) or 85.30 (Electrical signaling equipment for railways, tramways, roads, inland waterways, parking facilities, port installations or airfields (other than those of heading 86.08)).&&&&The Explanatory Notes to heading 85.31 state that, with the specified exceptions, the heading covers all electrical apparatus used for signaling purposes, whether using sound or using visual indication. The Explanatory Notes provide examples of goods covered by the heading, one of which is “Electric vapour or gas alarms, consisting of a detector and a sound or visual alarm, to warn of the presence of hazardous gaseous mixtures (e.g., natural gas, methane)”.&&&&The model MCT-442 detector meets the terms of heading 85.31 and is appropriately included therein; at the subheading level, this product is considered an ‘other’ apparatus of 8531.80.
