&&According to the information submitted, the product is a ladies’ mesh crop top with all over lace detail. It is fitted with extended shoulders, v-neckline with binding detail at the front and back. It has a buttoned back keyhole and hook and eye closure. The body of this garment is made of knitted power mesh intimate fabric (85% nylon and 15% elastane) and the trims of this garment are made of knitted lace (88% nylon and 12% elastane).

&&Section 10 of the Customs Tariff directs that classification of imported goods shall be determined in accordance with the General Rules for the Interpretation of the Harmonized System. The styling, fabric and characteristics of the garment demonstrate features typically associated with sleepwear.&&&&The submitted product falls within the scope of heading 61.08 which covers inter alia, nightdresses, pyjamas, négligés, dressing gowns and similar articles.&&&&The lace being more than mere trimming, this garment is considered a composite good consisting of different materials, it is classified according to the material which gives its essential character (GIR 3(b)). The lace gives the garment its essential character.&&&&In view of the foregoing and as per note 2 (A) to Section XI and Explanatory Notes to chapter 61 and heading 61.08, the good at issue meets the terms of subheading 6108.92 , referring to other sleepwear and similar articles of heading 61.08 made of man-made fibres.&&
