&&The product is 8mm copper wire with a circular profile. According to the information submitted, this product is made of copper cathodes in Amrod’s facilities in New Jersey, USA. The copper cathodes are melted, cast to a solid trapezoidal shaped bar, shaped into the 8mm circular profile and then treated against oxidation. The 8mm copper wire is sold in coils weighing a nominal 6,500lbs or 7,400lbs.
&&The tariff classification of the product has been addressed on TRS #285214 which determined that the good is classified under tariff classification number 7408.11.10.00 of the Customs Tariff, in accordance with GIR 1 and 6.&&&&As this product is obtained exclusively from non-originating materials, as per subsection 3(2) of Part 2 of the Canada-United States-Mexico Agreement (CUSMA) Rules of Origin Regulations, the non-originating materials used in the production of the good need to satisfy all applicable requirements of Schedule 1 of the CUSMA Rules of Origin Regulations. Subsection 3(6) also specifies that for the purpose of subsection 3(2), if Schedule 1 sets out two or more alternative rules under which a good is classified and the good satisfies the requirements of one of those rules, the good need not satisfy the requirements of another of the rules in order to qualify as an originating good.&&&&Article 1 of Schedule 1 of the CUSMA Rules of Origin Regulations states that the content of Schedule 1 is deemed to be the contents of sections A, B and C of Annex 4-B of the CUSMA. One of the product specific rules of origin applicable to subheading 7408.11, according to Section B of Annex 4-B of the CUSMA is:&&&&- a change to subheading 7408.11 from any other heading, except from heading 74.07&&&&The classification of the involved copper cathodes is 7403.11.00 according to the Certificate of Origin (USA-Chile) that was provided. As such, the non-originating materials of this product meet the product specific rule of origin applicable to subheading 7408.11. The product, 8mm copper wire with a circular profile, is therefore considered an originating product under the CUSMA.
