&&The goods in question are small enamel and stainless steel lapel pins, also known as brooches. They range in size from 1.25 to 1.75 inches, and have a rubber back enclosure. The stainless steel pins display Halloween-themed enamel artwork such as ghosts, jack-o-lanterns, witch's cauldrons, etc. They are intended to be worn as decorative objects of personal adornment.

&&Section 10 of the Customs Tariff directs that classification of imported goods shall be determined in accordance with the General Rules for the Interpretation of the Harmonized System and the Canadian Rules set out in the schedule. Section 11 of the Customs Tariff states that in interpreting the headings and subheadings, regard shall be had to the World Customs Organization's (WCO) Compendium of Classification Opinions and Explanatory Notes to the Harmonized Commodity Description and Coding System (HS).&&&&General Interpretative Rule 1 (GIR 1) directs that titles of Sections, Chapters and sub-Chapters are provided for ease of reference only. For legal purposes, classification shall be determined according to the terms of the headings and any relative Section or Chapter Notes. Similarly, General Interpretative Rule 6 (GIR 6) directs that classification shall be determined according to the terms of those subheadings and any related Subheading Notes.&&&&In your application for an advance ruling, you suggested tariff classification number 7117.19.90.00. This tariff classification number is correct.&&&&According to the Legal Note 9 and 11 of Chapter 71, imitation jewellery is defined as any small objects of personal adornment (for example, rings, bracelets, necklaces, brooches, earrings, watch-chains, fobs, pendants, tie-pins, cuff- links, dress-studs, religious or other medals and insignia, but excluding buttons or other articles of heading 96.06, or dress-combs, hair-slides or the like, or hairpins, of heading 96.15), not incorporating natural or cultured pearls, precious or semi-precious stones (natural, synthetic or reconstructed) nor (except as plating or as minor constituents) precious metal or metal clad with precious metal.&&&&Since the products under review meet this definition, they are considered imitation jewellery of heading 71.17, as per GIR 1. The pins, being made of base metal and not like cuff-links and studs, they are classified under subheading 7117.19, as per GIR 1 and 6.
