&&The product is a powdered rice protein concentrate, containing no additives and is packaged in 20 kg. paper bag with an inner plastic lining. The rice protein concentrate is composed of 85.3% protein on a dry weight basis, 5.9% fat, 4.3% carbohydrate, 4.3% dietary fibre 3.1% moisture, 1.43% ash and small amounts of sodium, calcium, potassium and phosphorus. It is anticipated that the product will be used in the manufacture of sports nutrition beverages but may also be incorporated into other food preparations where additional protein is desired.
&&Section 10 of the Customs Tariff directs that classification of imported goods shall be determined in accordance with the General Rules for the Interpretation of the Harmonized System. Section 11 of the Customs Tariff states that in interpreting the headings and subheadings, regard shall be had to the World Customs Organization's (WCO) Explanatory Notes to the Harmonized Commodity Description and Coding System.&&&&General Interpretative Rule 1 (GIR 1) directs that titles of Sections, Chapters and sub-Chapters are provided for ease of reference only. For legal purposes, classification shall be determined according to the terms of the heading and any relative Section and Chapter Notes. Similarly, General Interpretative Rule 6 (GIR 6) directs that classification shall be determined according to the terms of those subheadings and any related Subheading Notes.&&&&A proposed tariff classification number has not been provided in your submission; the tariff classification number as determined is found under the section titled “Decision”.&&&&Chapter 35 of the Customs Tariff provides for “Albuminoidal substances; modified starches; glues; enzymes:” and heading 35.04 provides for “Peptones and their derivatives; other protein substances and their derivatives, not elsewhere specified or included; hide powder, whether or not chromed.”. As the proteins are obtained from rice, they meet the terms of tariff item 3504.00.90.00 which provides for other protein substances from vegetables sources.&&
